Welcome to our website. If you continue to browse and use this website, you are agreeing to comply with and be bound by the following terms and conditions of use, and any subsequent amendments, which together with our privacy policy govern Globaltechbuddy.com’s (“GTB”) relationship with you in relation to this website. If you disagree with any part of these terms and conditions, please do not use our website.


GTB reserves the right, at its sole discretion, to modify, change, remove or add portions of these Terms of Use, at any time. It is your sole responsibility to periodically review these terms for any changes. The User’s ongoing use of the Site after publication of any possible changes to the current Terms indicates the User’s consent with the effective changes.


This GTB Terms of Service is provided to you (“Customer”) in connection with the Services that Customer has purchased. These terms and conditions comprise the entire agreement between Customer and GTB with respect to the Service.


The service

GTB services include interaction with a live technician over remote internet connection, or over phone support, who will attempt to improve the performance of your system by modifying your personal desktop software.

Example services include downloading and running both fee based and free software fixes, along with modifying and repairing operating systems and other software. List of other services is available on the services page. Hardware, network and application support beyond problem identification help is not available. The services are only available in the English language for customers in the United States and UK at this time. Training and training services are not included in the Service.

The Service requires a functioning high-speed Internet connection, which is a responsibility for the customer.

As a Registered customer of GTB we might call you for troubleshooting issues, Maintenance calls, Customer service/Feedback Calls, subscription Status / Renewal Calls or calls related to other operational matters. If you don’t wish to receive calls from us, you can do so by mailing us and GTB will process the request in a week.

Fees: In consideration for GTB providing its services or granting a license to certain GTB software for the term of this Agreement, You agree to pay a signup and service fee. These fees relate to a single personal computer only. Additional fees are required for additional computers, to transfer this service to a different computer, or to reconfigure this computer in the event of a hardware failure. GTB reserves the right to increase the fees at any time and the increased fees shall only be posted on the GTB website, which you should review from time to time.

If you selected a monthly payment plan your service will automatically be renewed following the initial term on a month-to-month basis. Monthly charges will continue until you provide written notice to GTB that you wish to cancel your service. If you selected an annual payment plan you will be notified via email at least 30 days prior to the end of your service term to renew services for the following year.


If Customer signs up for automatic renewal, his or her subscription will renew automatically at the end of each respective applicable period — on a month-to-month basis if Customer originally signed up for a one-month term.

Cancellation Policy:

If you select a monthly plan and terminate this agreement prior to the end of the one month term, there is will be no refund. To cancel the monthly plan minimum seven days notice, prior to next renewal date has to be sent in writing to customercare@globaltechbuddy.com and must include a reason for cancellation.

For yearly plan if you terminate this agreement prior to the end of the one year term, you agree to pay a cancellation fee equal to the remainder of the one year term, or $150, which ever amount is greater. GTB at their discretion can waive this fee in select cases.

If for any reason GTB is unable to charge your credit card or debit card with the full amount of the service provided GTB may pursue all available remedies in order to obtain payment, including turning your account over to a collection agency. In addition, GTB is entitled to recover any sums expended in connection with the collection of fees, including reasonable collection agency fees and attorney’s fees.

Refund and other Guarantee Policy

Refunds will not be issued after services have been rendered. Under our Satisfaction guarantee, if the same issue occurs again on the same device within seven days of the fix, we will fix it again for free, but this is not a rolling policy, so GTB will fix an issue a maximum of two times, however on exceptional basis GTB might decide to increase if beyond two fixes. This is at sole discretion of GTB.

If you request a refund on services not rendered, you will incur administrative costs, which are equal to $25. If you do not want to incur this fee, GTB will keep your service available to you for up to one year, after which a refund will not be available.

If GTB is unable to solve a computer software problem or determines that a customer’s computer is not repairable, a partial refund may be issued at the sole discretion of GTB and on a case by case basis.

For our one off technical support fees, GTB will not charge you if we are unable to fix the problem raised by the customer. This however does not apply to monthly/yearly packages, where GTB might not be able to solve all the issues raised by the customer. We will attempt to resolve all issues to the best of our ability, but no refund are offered for these plans in case GTB is unable to resolve your issues.

For our lowest price guarantee, the customer is responsible to collect and submit proof of a similar service as us a cheaper level to billing@globaltechbuddy.com. Refunds of the excess amount will only be issued if GTB is convinced that the other service is indeed offering more to the customer at a cheaper level. GTB is the sole decision making authority for such claims.

All requests for refunds shall be made via a written notice to the GTB billing department at billing@globaltechbuddy.com.

Your Cooperation: You agree that your computer has a high-speed or broadband connection to the Internet (specifically a quality, stable broadband connection with a minimum continuous connection speed of 256Kb/s upload and download). You agree to allow GTB to temporarily control your computer and access your computer functions. You agree to leave your computer and internet connection operating while GTB is diagnosing, downloading or fixing your computer. For the most efficient and cost effective service, you agree to allow GTB  to download certain suggested software (may require fee-based if sufficient freeware is not available) or remove harmful software or databases to facilitate proper diagnosis or functioning of your computer. While GTB will attempt to obtain your prior approval before deleting or installing important software, you agree to allow GTB to improve your computer operations without obtaining your prior approval. Furthermore, you agree to provide genuine operating system installation media (or other legitimately licensed digital or physical software) if GTB determines that such media is required in order to repair any given problem or complete service.


Customer’s responsibility to back-up data

Customer agrees that prior to GTB servicing any customer equipment it is the customer’s responsibility to

  • Back-up the data, software, information or other files stored on customer’s computer disk drives, peripherals, MP3 player, DVD player, and/or on any other electronic storage device.
  • Remove all videotapes, compact disks, floppy disks, laser disks, cassettes, DVDs, film or other media from customer’s device. Customer agrees that whether or not customer requests back-up services from GTB and/or its third party service provider, neither GTB nor its third party service provider shall be liable under any circumstances for any loss, disclosure, alteration or corruption of any data, software, information, files, videotapes, compact disks, floppy disks, laser disks, cassettes, DVDs, film or other media.


Limitations to service

GTB shall not be in default of any obligation under the Agreement if the failure to perform the obligation is due to any event beyond its control, including, without limitation, significant failure of a portion of the power grid, significant failure of the Internet, natural disaster, war, riot, insurrection, epidemic, strikes or other organized labour action, terrorist activity, or other events of a magnitude or type for which precautions are not generally taken in the industry.


Privacy policy

It is GTB policy to respect the privacy of its Customers. We would never ask you for your confidential financial details either via mail or phone. See our Privacy policy for full details.


Indemnification

Customer agrees to indemnify, defend, and hold harmless GTB (and its affiliates and their respective officers, directors, employees and agents) from and against any and all losses, costs, obligations, liabilities, damages, actions, suits, causes of action, claims, demands, liens, encumbrances, security interests, settlements, judgments, and other expenses, (including but not limited to cost of defense, settlement, and reasonable attorneys’ fees) of whatever type or nature, including, but not limited to, damage or destruction to property, injury (including death) to any person or persons, which are asserted against, incurred, imposed upon or suffered by GTB by reason of, or arising from the following:

  • Customer’s breach of these Terms;
  • Customer’s actual or alleged infringement of any patent, copyright, trademark, trade secret or other property or contract right of any other person;
  • Customer’s actual or alleged failure to promptly pay sums due “GTB ” or third parties;
  • Customer’s failure to comply with applicable laws, regulations or ordinances;
  • The acts or omissions of Customer (or its officers, directors, employees or agents).
Disclaimer: THE GTB AND VENDOR SOFTWARE DOWNLOADED BY GTB (OR SUGGESTED BY GTB) TO YOUR COMPUTER AND THE MATERIALS AND SERVICES PROVIDED BY GTB ARE PROVIDED “AS IS” WITHOUT ANY GTB WARRANTIES OF ANY KIND INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF INTELLECTUAL PROPERTY. GTB DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE AVAILABILITY, USE, TIMELINESS, SECURITY, VALIDITY, ACCURACY, EFFECTIVENESS OR RELIABILITY OF, OR THE RESULTS OF THE USE OF, OR OTHERWISE RESPECTING, THE GTB SERVICES OR THE CONTENT OR FUNCTIONALITY OF THE GTB OR VENDOR SOFTWARE, SITE OR ANY OTHER WEB SITES LINKED TO OR FROM THE SITE. BECAUSE SOME JURISDICTIONS PROHIBIT THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. Any software or material for which GTB suggests or downloads to Your computer is implemented at Your own discretion and risk and You are solely responsible for any damage to Your computer system or loss of data that results from the download of any such material, or use of this site.


Limitation of liability

GTB SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE OR FOR COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES OR RESULTING FROM ANY GOODS OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH THE SERVICE OR RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF CUSTOMER’S TRANSMISSIONS OR DATA, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE, EVEN IF GTB HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO EACH CUSTOMER. It is Customer’s responsibility to back-up the software and data that is stored on Customer’s computers, hard disk drive(s), and/or on any other storage devices Customer may have, and the GTB shall not be responsible at any time for any loss, alteration, or corruption of any software, data, or files. GTB shall not be liable in any way for damages arising from any service or software or other product supplied to Customer by GTB. Notwithstanding any language to the contrary, GTB maximum liability to Customer arising from or related to GTB under this Agreement shall be limited to the sums paid by Customer to GTB under this Agreement during the three months prior to the time the cause of action arose.

Entire Agreement: These Terms constitute the entire agreement between the parties concerning the purpose of these Terms and supersedes any other agreements and understandings concerning this purpose. These Terms may be amended, waived, or revoked only by written agreement of both parties. Failure to enforce any provision of these Terms will not act as a waiver of any term or right set forth herein.

Acceptance of Terms: You acknowledge that you have read, and agree to be bound by these Terms. You agree/represent you have the legal authority to accept these Terms on behalf of yourself or any party you represent. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT USE THE SITE AND UNINSTALL ANY GTB SOFTWARE OR VENDOR SOFTWARE DOWNLOADED TO YOUR COMPUTER BY GTB.
